Klauzula informacyjna – portal społecznościowy LinkedIn

W związku z wykorzystywaniem portalu LinkedIn przez ZETO SOFTWARE Sp. z o.o. i prowadzeniem profilu na portalu LinkedIn przez ZETO SOFTWARE Sp. z o.o., na podstawie art. 13 ust. 1 i 2 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej jako: „RODO”) informujemy, że:

  1. Administratorem Państwa danych osobowych udostępnionych poprzez portal LinkedIn (www.linkedin.com) jest ZETO SOFTWARE Sp. z o. o., prowadząca działalność pod adresem:
    10-005 Olsztyn ul. Seweryna Pieniężnego 6/7, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Sąd Rejonowy w Olsztynie, VIII Wydział Gospodarczy pod nr KRS 0000059536, kontakt – rodo@zetosoftware.pl, tel. 895217200, www.zetosoftware.pl, (dalej jako: „Administrator”). Firma LinkedIn Ireland Unlimited Company jest dla krajów UE administratorem danych osobowych użytkowników portalu dostarczanych, przetwarzanych bądź gromadzonych przez Usługi portalu lub na potrzeby tych Usług. Pełna polityka prywatności portalu LinkedIn umieszczona jest pod adresem: https://www.linkedin.com/legal/privacy-policy?_l=pl_PL. Kontakt do inspektora ochrony danych (Data Protection Officer) firmy LinkedIn dostępny jest pod adresem: https://www.linkedin.com/help/linkedin/ask/TSO-DPO.
  2. Państwa dane osobowe udostępniane są Administratorowi poprzez portal LinkedIn m. in. w czasie wizyty na profilu firmowym Administratora (dalej „Profil”), w wyniku publikowania lub przesyłania danych poprzez usługi oferowane przez portal LinkedIn (np. przesyłanie komunikatów, wypełnianie formularzy, odpowiadanie na ankiety, przesyłanie CV).
  3. Państwa dane będą przetwarzane na następujących podstawach prawnych oraz w celu:
  1. prowadzenia, administrowania i zarządzania przez Administratora Profilem na portalu LinkedIn, zgodnie z regulaminem opublikowanym przez LinkedIn Ireland Unlimited Company, podjęcia działań na żądanie osoby, której dane dotyczą, w tym przygotowywania i udzielania odpowiedzi na Państwa pytania przesyłane za pośrednictwem komunikatora, komunikacji za pośrednictwem dostępnych funkcjonalności serwisu LinkedIn (komentarze), przed zawarciem umowy (art. 6 ust. 1 lit. b RODO) oraz z uwagi na uzasadniony interes Administratora (art. 6 ust. 1 lit. f RODO),
  2. prowadzenia rekrutacji kandydatów do pracy u Administratora:
  • w zakresie wynikającym z art. 22 (1) Kodeksu pracy, podstawą prawną jest obowiązek prawny spoczywający na Administratorze (art. 6 ust. 1 lit. c RODO). Dotyczy to takich danych, jak: imię (imiona) i nazwisko, data urodzenia oraz dane kontaktowe wskazane przez kandydata do pracy. Jeśli jest to niezbędne do wykonywania pracy określonego rodzaju lub na określonym stanowisku, dotyczy to również informacji o wykształceniu, kwalifikacjach zawodowych i przebiegu dotychczasowego zatrudnienia. Obowiązek prawny spoczywający na Administratorze obejmuje również te dane, których podanie jest niezbędne do zrealizowania uprawnienia lub spełnienia obowiązku wynikającego z przepisu prawa;
  • w przypadku podania przez kandydata do pracy danych osobowych w zakresie szerszym niż określony w przepisach prawa pracy, podstawą prawną ich przetwarzania w ww. celu jest zgoda kandydata (podstawa z art. 6 ust. 1 lit. a RODO). Dotyczy to wszelkich danych podanych przez kandydata do pracy w życiorysie (CV), liście motywacyjnym bądź udostępnionych w trakcie rozmów kwalifikacyjnych.
  1. prowadzenia marketingu bezpośredniego – z uwagi na uzasadniony interes Administratora
    (art. 6 ust. 1 lit. f RODO),
  2. prowadzenia analiz dotyczących oferowanych przez Administratora produktów i usług, w tym badań ich jakości czy oceny satysfakcji klientów – w związku z uzasadnionym interesem Administratora (art. 6 ust. 1 lit. f RODO),
  3. dochodzenia roszczeń i obrony przed roszczeniami – w związku z uzasadnionym interesem Administratora (art. 6 ust. 1 lit. f RODO).

Ponadto informujemy, że administrator portalu LinkedIn jako dostawca narzędzi jest podmiotem współodpowiedzialnym za przetwarzanie danych osób korzystających z profilu firmowego ZETO SOFTWARE Sp. z o. o., który może przetwarzać ich dane we własnych celach w oparciu o inne podstawy prawne.

  1. Zakres danych osobowych przetwarzanych w celach opisanych powyżej obejmuje Państwa imię, nazwisko, wizerunek oraz inne dane identyfikacyjne udostępnione przez Państwa publicznie
    w profilu utworzonym w portalu LinkedIn. Zakres danych osobowych przetwarzanych dla potrzeb rekrutacji obejmuje dane wskazane w ust. 3 lit. b) powyżej.
  2. Odbiorcy danych: Państwa dane osobowe podawane na portalu LinkedIn w związku z korzystaniem z Profilu mogą być dostępne dla administratora tego portalu LinkedIn Ireland Unlimited Company. Jednocześnie wszelkie dane osobowe zawarte w komentarzach zamieszczanych na Profilu mogą być również dostępne dla innych użytkowników portalu LinkedIn.
  3. Administrator nie zamierza przekazywać danych do państwa trzeciego lub organizacji międzynarodowej. Specyfika działania portalu LinkedIn i jego międzynarodowy charakter powodują jednak, że potencjalnie możliwy jest transfer danych poza EOG (nie jest to zależne od Administratora).
  4. Państwa dane osobowe będą przetwarzane:
  1. przez okres prowadzenia korespondencji zainicjowanej zapytaniem przesłanym za pomocą komunikatora – do czasu upływu 3 miesięcy od daty jej zakończenia,
  2. przez okres prowadzenia rekrutacji kandydatów do pracy u Administratora – do czasu jej zakończenia, a wobec osób, które wyraziły zgodę na przetwarzanie danych osobowych na potrzeby przyszłych rekrutacji – przez okres 2 lat od daty złożenia aplikacji,o ile przed upływem tego okresu zgoda nie zostanie wycofana,
  3. do czasu cofnięcia wyrażonej zgody lub zgłoszenia sprzeciwu wobec przetwarzania danych –
    w przypadkach przetwarzania Państwa danych osobowych na podstawie odrębnej zgody lub na podstawie wymienionej w art. 6 ust. 1 lit. e lub f RODO, w tym na potrzeby marketingu bezpośredniego.
  4. Podanie przez Państwa danych osobowych jest dobrowolne, ale wymagane:
  1. do udzielenia odpowiedzi na Państwa zapytanie przesłane za pomocą komunikatora
    (brak danych może skutkować niemożnością obsługi zapytania przez Administratora),
  2. do wzięcia udziału w prowadzonej przez Administratora rekrutacji, przy czym niepodanie danych będzie skutkować brakiem możliwości uczestniczenia w procesie rekrutacyjnym,
  3. w celu korzystania z wszystkich funkcjonalności portalu LinkedIn w odniesieniu do Strony.
  1. Administrator nie wykorzystuje do przetwarzania Państwa danych osobowych narzędzi do zautomatyzowanego podejmowania decyzji, w tym profilowania.
  2. Przysługuje Państwu prawo dostępu do swoich danych osobowych przetwarzanych przez Administratora, do ich sprostowania, usunięcia, ograniczenia przetwarzania tych danych lub do ich przeniesienia. Przysługuje Państwu prawo do wniesienia sprzeciwu wobec przetwarzania danych oraz do cofnięcia wyrażonej zgody (pozostanie to bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem).
  3. W przypadku uznania, że przetwarzanie przez Administratora danych osobowych narusza przepisy RODO przysługuje Państwu prawo do zgłoszenia skargi do organu nadzorczego (tj. Prezesa Urzędu Ochrony Danych Osobowych).

Due to using by ZETO SOFTWARE Sp. z o.o. the LinkedIn site, and maintaining its profile there, pursuant to Art. 13 items 1 and 2 of the Regulation of the European Parliament and of the Council (UE) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE (referred to as „GDPR”) we hereby inform you that:

  1. ZETO SOFTWARE Sp. z o.o. is the Administrator of your personal data made accessible by the LinkedIn site (www.linkedin.com). ZETO Software is registered at the following address:
    10-005 Olsztyn ul. Seweryna Pieniężnego 6/7, entered into the Register of Enterpreneurs of the National Court Register maintained by the District Court of Olsztyn, VIII Commercial Department, under the KRS n.o. 0000059536. Contact details: rodo@zetosoftware.pl, tel. +48895217200, www.zetosoftware.pl, (hereinafter referred to as: The Administrator). LinkedIn Ireland Unlimited Company administers the EU countries users’ data, as far as the data providing, processing or storing by the site or for the purpose of the site’s services.   2. Your personal data is made available to the Administrator through the LinkedIn site during visits on the Administrator’s profile (hereinafter referred to as the Profile), and as a consequence of publishing or sending data trough services offered by LinkedIn (e.g. sending messages, filling in forms, questionnaires, resumés).
  3. Your personal data shall be processed based on the following legal basis and purposes:
  1. maintaining, administering and managing the LinkedIn Profile by the Administrator, according to the Rules and Regulations published by LinkedIn Ireland Unlimited Company; undertaking action pursuant to a request of a personal data holder, including preparing and responding to questions sent via messenger; communication through LinkedIn’s available functionalities (commentaries) before a contract has been signed (Art.6 item 1.b of GDPR) and due to Administrator’s reasonable interests (Art. 6 item 1.f of GDPR);
  2. conducting Administrator’s recruitment process:
  • within the scope referred to in Art. 22 (1) of the Labour Code, the legal basis being the Administrator’s legal responsibility (Art. 6 item 1.c of GDPR). The above refers to data such as: first and last name(s), date of birth, contact data provided by a job applicant. It also refers to information on education, job qualifications and employment history, if such data is indispensable in order to perform specific duties or hold a specific post. The legal responsibility of the Administrator also comprises the data indispensable to fulfil the qualifications or duties resulting from a legal provision;
  • If a candidate provides a wider scope of data than the one indicated by the Labour Code, it shall be processed within the above mentioned purposes based on a candidate’s agreement (legal basis: Art. 6 item 1.a of GDPR). The above refers to every data provided in a CV, in a motivation letter or upon a job interview;
  1. conducting direct marketing operations – due to Administrator’s reasonable interest (Art. 6 item 1.f of GDPR);
  2. conducting analyses of the Administrator’s services and products, including quality research and customer satisfaction surveys – regarding the Administrator’s reasonable interest (Art. 6 item 1.f of GDPR);
  3. pursuing claims and defence against claims – regarding the Administrator’s reasonable interest (Art. 6 item 1.f of GDPR).

Moreover, we hereby inform you that the administrator of the LinkedIn site, being a tool supplier, is jointly responsible for processing data of the users of ZETO SOFTWARE Sp. z o.o.’s company Profile, which is allowed to process their data for their own purposes, based on other legal regulations.

  1. The scope of data processed within the above mentioned purposes comprises: first and last name, image and other identification data made available to the public on your LinkedIn account. The scope of personal data processed for recruitment purposes comprises the data indicated in item 3.b above.
  2. Data recipients: Your personal data made available to LinkedIn site upon the use of your account can be accessible to the administrator of LinkedIn Ireland Unlimited Company. All personal data included in comments posted within the account can also be accessible to other LinkedIn users.
  3. The Administrator shall not make your data available to another country or international organisation. The specific international character of LinkedIn makes your data probable to be transferred outside EEA (independently of the Administrator).
  4. Your personal data shall be processed:
  1. for the period of correspondence exchange initiated by a messenger question – and within 3 months from ending the correspondence;
  2. within the duration of the Administrator’s recruitment process – until its end, and as regards the persons who gave their consent for personal data processing for the purpose of future recruitment – within 2 years from filing a job application, as long as it has not been withdrawn earlier;
  3. until a given consent has been withdrawn or permission for data processing has been refused – in the case of your personal data processing based on a separate consent or based on Art. 6 item 1.e or 1.f of GDPR, direct marketing included.
  4. Making your personal data available is voluntary, but required:
  1. in order to respond to your request sent via messenger (lack of data can make the Administrator unable to process the request);
  2. in order to take part in the recruitment process performed by the Administrator, where lack of data shall disqualify from the recruitment process;
  3. in order to use all LinkedIn functionalities.
  1. The Administrator does not use, within the scope of data processing, automated decision-making tools, profiling included.
  2. You reserve the right to access your personal data processed by the Administrator, to correct it, to have it removed, to limit the scope of its processing or to have it transferred. You reserve the right to appeal against the processing of your data and to withdraw your consent (with no influence on accordance with the right to process the data, arising from the consent given before the withdrawal).
  3. If you consider the processing of your personal data as infringing GDPR, you reserve the right to file a complaint to a supervising authority (i.e. The Chairman of the Office for Protection of Personal Data).
